1. General Terms

By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these terms and conditions.

1.2. Eligibility
You must be at least 18 years old to use our services. By using our services, you represent that you meet this requirement.

2. Services Provided

2.1. Web Development and Design
We provide custom web development, design, branding, and related digital services as outlined in the project proposal or service agreement. Each project is unique and includes services as agreed upon between you and Code Your Ideas.

2.2. Scope of Work
All services provided will be detailed in a proposal, contract, or service agreement, which includes a description of deliverables, timeline, and cost. Any additional services or modifications requested beyond the initial agreement may be subject to additional charges.

3. Pricing and Payment

3.1. Project Pricing
Pricing for each project will be specified in the service agreement. Code Your Ideas reserves the right to adjust the price based on project scope changes or additional features requested.

3.2. Payment Terms

• A non-refundable deposit of 40% of the total project cost is required upfront to initiate work.
• The remaining balance is due upon project completion and before the final delivery of the website or service.
• Payment must be made via bank transfer, PayPal, our website or any other agreed payment method.
• Pay must be paid before the agreed due date to avoid project delays or suspension of services.
• payment is available using our website. If you use the instalments payment through the website and your card is declined on 1st payment it is counted as suspension of services and your site may be unpublished or deleted permanently. It is taken as breaking the service agreement.

4. Revisions and Changes

4.1. Revisions
All projects include a specified number of revisions as outlined in the service agreement. Any revisions requested beyond the included rounds may incur additional charges.

4.2. Change Requests
If you request changes after the project has started that fall outside the scope of the original agreement, additional costs may be applied. Code Your Ideas will notify you of additional costs before proceeding with the work.

5. Client Responsibilities

5.1. Provision of Materials
You agree to provide all necessary materials (such as logos, content, images, etc.) on time to ensure the project stays on schedule.

5.2. Content Ownership
You must ensure that any content provided to us for use in your website or project is owned by you or you have permission to use it. Code Your Ideas will not be liable for any copyright or intellectual property infringement resulting from the use of third-party materials without permission.

6. Intellectual Property

6.1. Ownership of Deliverables
Upon full payment, all website designs and development work completed by Code Your Ideas for the client will become the property of the client.

6.2. Code Ownership
Custom code and proprietary tools used by Code Your Ideas remain the intellectual property of Code Your Ideas unless otherwise agreed upon. The client is granted a license to use the code for the purpose it was developed.

7. Project Timelines

7.1. Completion Date
We will make every effort to meet agreed-upon timelines, but delays may occur due to unforeseen circumstances. Code Your Ideas is not responsible for delays caused by factors outside our control, including but not limited to client delays in providing necessary content or approvals.

7.2. Force Majeure
We will not be held liable for delays or failures in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, power outages and others.

8. Cancellation and Refund Policy

8.1. Cancellation by Client
If you choose to cancel the project after the deposit has been paid but before work begins, the deposit is non-refundable. If the project has already commenced, you will be billed for work completed up to the point of cancellation.

8.2. Cancellation by Code Your Ideas
We reserve the right to cancel a project at any stage if the client violates these terms and conditions, becomes unresponsive for an extended period ( more than 10 business days, or engages in any activity that is unlawful or unethical. Any refunds or billing will be determined on a case-by-case basis.

9. Limitation of Liability

Code Your Ideas will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or the failure to meet client expectations. Our total liability for any claim related to our services is limited to the amount paid by the client for the services.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Poland. Any disputes arising from the use of our services or these terms will be subject to the jurisdiction of Polish courts.

11. Amendments to Terms

Code Your Ideas reserves the right to update or modify these terms and conditions at any time without prior notice. Any changes will be posted on our website, and continued use of our services after such changes constitutes acceptance of the new terms.
